Personal Data and It’s Acquisition

Personal data is any information about an identified or identifiable natural person (hereinafter - Data Subject) - potential/current/former customer, cooperation partner and other person who is connected in one way with SIA ELKS AK or the services and/or products offered by it. 

SIA ELKS AK obtains and processes only personal data that the Data Subject provides voluntarily.

The categories of personal data that SIA ELKS AK mostly, but not exclusively, obtains and processes are:

·         Identification data, such as name, surname, personal identification number, date of birth, identity document data (e.g. passport copy, ID card), nationality;

·         Contact information, for example, postal address, telephone number, a-mail address;

·         Financial date, for example, bank or payment institution account number, debit/ credit card details;

·         Communication data collected when the Data Subject meets the representatives of SIA ELKS AK or contact SIA ELKS AK by phone, electronic means, complete forms at the website or otherwise directly.

Personal Data Processing

The processing of personal data is carried out on the basis of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data and which repeals Directive 95/46/EC (General data protection regulation) (hereinafter - the Regulation) and other applicable regulatory enactments in the field of privacy and data processing, taking into account the reasonably available organizational, financial and technical resources of SIA ELKS AK.

SIA ELKS AK uses the collected personal data for the following:

• to provide the requested services and information to the Data Subject;
• to process the orders placed by the Data Subject and prepare the necessary documents;
• to provide the Data Subject with effective customer support, help prevent threats or fraudulent activities;
• to send informational messages and other direct marketing activities to the Data Subject, if the Data Subject has expressly agreed to receive them, to which the Data Subject has the right to refuse such data processing at any time to the extent that it is related to direct marketing;
• to comply with the requirements of regulatory enactments, including transferring personal data to third parties in order to comply with the requirements of regulatory enactments, cooperate with supervisory authorities, help prevent criminal activities and protect the legal rights and interests of SIA ELKS AK, the Data Subject and other persons;
• for conducting market research and statistics.

The Protection of Personal Data

SIA ELKS AK uses various technical and organizational security measures to protect personal data. The personal data of the Data Subject is accessible to a limited number of people, only to authorized persons.

The Storage of Personal Data

SIA ELKS AK stores personal data for as long as it is necessary according to the purpose of its acquisition and as permitted or determined by the requirements of regulatory acts.

The Rights of Data Subject

The Data Subject has the right to access his/her personal data held by SIA ELKS AK, to request correction of his/her personal data that is inaccurate, in the cases specified in the Regulation to request restriction of data processing, in justified cases to request deletion of personal data, to object at any time to the processing of his/her personal data based on to the legal interests of SIA ELKS AK, based on reasons related to the special situation of the Data Subject.

If the data processing is carried out only on the basis of consent, the Data Subject has the right to withdraw his/her consent at any time (withdrawal of consent does not affect the legality of the data processing carried out until the withdrawal).

The Data Subject has the right to withdraw his/her consent to the processing of personal data and to obtain the deletion of his/her personal data without undue delay, as soon as the data is no longer necessary to provide the services requested by the Data Subject and to comply with the requirements of regulatory acts.
